These Terms of Service (“Terms”) constitute a legally binding agreement between you (“Client,” “you,” or “your”) and Drone Studio NC (“Company,” “we,” “us,” or “our”), a professional drone services provider headquartered in Raleigh, North Carolina. By requesting a quote, booking a service, making a payment, or otherwise engaging Drone Studio NC to perform any of our professional drone services, you acknowledge that you have read, understood, and agree to be bound by these Terms in their entirety. If you do not agree with any part of these Terms, please do not use our services.
Drone Studio NC provides FAA Part 107 compliant commercial drone services across Raleigh, the Triangle, and throughout North Carolina including, but not limited to: aerial photography and videography; surveying and mapping; drone inspections (visual and thermal); wedding drone services; private celebration drone coverage; corporate event drone services; and related aerial data capture, processing, and delivery services for clients in agriculture, construction, and real estate and insurance. The specific scope, deliverables, timeline, and pricing for each engagement are outlined in the individual project proposal or service agreement provided to the Client prior to commencement of work.
Proposals and Acceptance: All engagements begin with a written project proposal that details the scope of work, deliverables, pricing, and estimated timeline. The engagement is considered confirmed once the Client accepts the proposal in writing (including email) and submits any required deposit payment.
Pricing: Service pricing is quoted on a per-project basis and is valid for 30 days from the date of the proposal unless otherwise stated. Prices are in U.S. dollars and do not include applicable sales tax unless explicitly noted.
Payment Terms: A non-refundable deposit of 50% of the total project cost is required to confirm your booking and reserve your date. The remaining balance is due upon delivery of final deliverables unless alternative payment terms are agreed upon in writing. For recurring service programs (such as construction progress monitoring or seasonal agricultural flights), payment terms will be outlined in the service agreement.
Late Payment: Invoices not paid within 15 days of the due date may be subject to a late fee of 1.5% per month on the outstanding balance. Drone Studio NC reserves the right to withhold deliverables until all outstanding balances are paid in full.
Client Cancellation: If the Client cancels a confirmed booking more than 72 hours before the scheduled flight date, the deposit will be applied as a credit toward a future booking valid for 12 months. Cancellations made within 72 hours of the scheduled flight are non-refundable, as pilot scheduling and mission planning resources have already been allocated.
Rescheduling: Clients may reschedule a confirmed booking at no additional charge with at least 48 hours’ notice, subject to pilot and date availability.
Weather Delays: Drone operations are weather-dependent. If a scheduled flight cannot be safely conducted due to adverse weather conditions (rain, high winds, low visibility, thunderstorms), Drone Studio NC will reschedule the flight at no additional cost to the Client at the earliest mutually available date. Weather-related rescheduling is not considered a cancellation.
All Drone Studio NC operations are conducted in full compliance with Federal Aviation Administration (FAA) regulations under 14 CFR Part 107. Our pilots hold valid FAA Part 107 Remote Pilot Certificates and follow standardized safety protocols for every flight across Raleigh, the Triangle, and throughout North Carolina. Drone Studio NC is responsible for obtaining any required FAA airspace authorizations (LAANC or manual waivers) for flights in controlled airspace near Raleigh-Durham International Airport and other NC airports. The Client is responsible for ensuring that we have legal access to the property or site where the drone services will be performed. If a flight cannot be safely or legally conducted due to airspace restrictions, temporary flight restrictions (TFRs), or site access issues outside our control, we will work with the Client to reschedule or modify the mission plan accordingly.
Ownership: Upon receipt of full payment, the Client receives a non-exclusive, perpetual license to use all delivered aerial photographs, video footage, survey data, inspection reports, and other project deliverables for the purposes outlined in the project proposal. Drone Studio NC retains the underlying copyright to all creative works produced unless a full copyright transfer is agreed upon in writing and reflected in the project pricing.
Portfolio Use: Drone Studio NC reserves the right to use anonymized or non-confidential samples of delivered work in our portfolio, website, social media, and marketing materials unless the Client explicitly requests confidentiality in writing prior to commencement of the project.
Delivery Timeline: Standard delivery timelines are 48 hours for aerial photography, 5 business days for videography and cinematic edits, and 3 to 5 business days for inspection reports and survey data. Rush delivery is available for an additional fee. Delivery timelines begin after the flight mission is completed.
Data Retention: Completed deliverables and raw project data are retained on our secure servers for 90 days following final delivery. After this period, data may be archived or permanently deleted. Clients who require extended retention should request this in writing before or at the time of booking.
The Client agrees to provide accurate and complete information about the project site, property, event, or subject of the drone services; ensure that Drone Studio NC has authorized legal access to the site or venue where services will be performed; inform Drone Studio NC of any known hazards, restrictions, or special conditions at the project location; obtain any necessary permissions from property owners, venue managers, event coordinators, or relevant third parties prior to the scheduled flight; and communicate any specific confidentiality, safety, or operational requirements in advance of the engagement.
Insurance: Drone Studio NC maintains comprehensive general liability insurance with minimum coverage of $1,000,000 per occurrence. Certificates of insurance (COI) are available upon request for any project.
Limitation of Liability: To the maximum extent permitted by law, Drone Studio NC’s total liability for any claim arising from or related to our services shall not exceed the total amount paid by the Client for the specific project giving rise to the claim. Drone Studio NC shall not be liable for any indirect, incidental, consequential, special, or punitive damages, including but not limited to lost profits, lost revenue, or business interruption, regardless of the cause of action.
Force Majeure: Drone Studio NC shall not be held liable for delays or failure to perform services due to circumstances beyond our reasonable control, including but not limited to severe weather, natural disasters, FAA-imposed flight restrictions, government actions, equipment failure due to manufacturer defect, or other force majeure events.
The Client agrees to indemnify and hold harmless Drone Studio NC, its owner, employees, pilots, and contractors from and against any claims, damages, losses, liabilities, and expenses (including reasonable attorney fees) arising from the Client’s breach of these Terms, the Client’s misuse of delivered content or data, the Client’s failure to obtain required site access or permissions, or any inaccurate or misleading information provided by the Client in connection with the engagement.
Drone Studio NC treats all client project details, property information, aerial data, and business information as confidential. We will not disclose confidential client information to third parties without the Client’s written consent, except as required by law or as necessary to fulfill the contracted services (for example, sharing deliverables with the Client’s designated team members or stakeholders as instructed).
Any disputes arising from or related to these Terms or the services provided by Drone Studio NC shall first be addressed through good-faith negotiation between the parties. If a resolution cannot be reached through negotiation within 30 days, the dispute shall be resolved through binding arbitration administered in Wake County, North Carolina, in accordance with the rules of the American Arbitration Association. The prevailing party shall be entitled to recover reasonable attorney fees and costs.
These Terms shall be governed by and construed in accordance with the laws of the State of North Carolina, without regard to its conflict of law provisions. Any legal proceedings shall be conducted in the state or federal courts located in Wake County, North Carolina.
Drone Studio NC reserves the right to update or modify these Terms of Service at any time. When changes are made, we will update the “Last Updated” date at the top of this page. Changes will apply to all new engagements booked after the effective date of the updated Terms. Existing confirmed bookings will be governed by the Terms in effect at the time of booking confirmation.
